Terms of Service

Effective Date: September 2026

Overview

These Terms of Service govern your access to and use of the Native Ground Land Management LLC website (nativegroundlandmanagement.com and related pages).

Important: These website Terms apply only to your use of this website. They do not govern land-management, forestry, grading, or any other services that Native Ground actually performs for customers.

If you hire Native Ground for land-management or related services, those services are governed separately by the applicable estimate, quote, proposal, work authorization, or other agreement between you and Native Ground. If there is any conflict between these website Terms and a separate project agreement concerning actual services performed, the project agreement controls.

Acceptable Use of This Website

You agree to use this website only for lawful purposes. Specifically, you agree not to:

  • Attempt to gain unauthorized access to the website or its underlying systems
  • Interfere with or disrupt the operation or security of the website
  • Introduce malware, viruses, or other malicious code
  • Use website content unlawfully or in violation of any applicable law
  • Engage in fraudulent, deceptive, or unlawful activity through the website

Website Information and Content Accuracy

Native Ground makes reasonable efforts to provide accurate and current information on this website. However, website information is subject to change without notice.

Services, service areas, availability, equipment, project timelines, capabilities, and other information may change based on business conditions, weather, equipment availability, and other factors.

Website content is general information intended to help you understand what Native Ground does and how to contact us. Nothing on this website should be interpreted as a binding project estimate, guaranteed price, binding quote, or a representation that Native Ground can perform a specific project. Actual project scope, pricing, scheduling, timeline, site conditions, equipment needs, and other job-specific details are determined separately after Native Ground evaluates your specific property and project.

Contact Forms, Inquiries, and Estimate Requests

When you submit a contact form, request information, ask for an estimate, call, text, or email Native Ground, you represent that the information you provide is accurate and truthful.

Submitting a contact form, requesting an estimate, or contacting Native Ground does not automatically:

  • Create a contract or agreement
  • Guarantee that Native Ground will accept your project
  • Guarantee availability or a specific project date
  • Establish final pricing
  • Establish the final scope of work
  • Reserve or hold a date for your project

Native Ground typically schedules an on-site visit to evaluate your property, understand your goals, discuss site conditions, and assess the project before providing a detailed estimate or agreeing to perform the work. A formal estimate or proposal may be provided, and work will only begin after you and Native Ground have reached agreement and established clear project terms.

While Native Ground strives to respond to inquiries promptly, we do not guarantee a specific response timeframe.

Intellectual Property

Website text, graphics, logos, branding, photographs, before-and-after images, videos, project descriptions, and other original materials on this website are owned by Native Ground Land Management LLC or used with permission.

You may view this website and its content for ordinary personal and informational purposes. You agree not to:

  • Copy, republish, or redistribute website content without permission
  • Modify, adapt, or create derivative works based on website content
  • Use website content, project photographs, or before-and-after images for commercial purposes
  • Use website content to compete with or disparage Native Ground
  • Remove or alter any copyright, ownership, or attribution notices

Project Photographs and Examples of Previous Work

Photographs, before-and-after images, project descriptions, and examples of previous work shown on this website are provided to demonstrate Native Ground's prior projects and capabilities.

Results shown from previous projects do not guarantee identical results on another property. Every property and project involves different terrain, vegetation, soil conditions, site access, weather, customer goals, budget, and other unique factors. Native Ground will evaluate your specific property to determine what is possible, practical, and appropriate for your situation.

Third-Party Links and Services

This website may link to or integrate with third-party websites and services, including Google, Google Maps, Google Business Profile, Facebook, Squarespace, and others. Native Ground does not control these third-party services and is not responsible for their content, availability, functionality, privacy practices, or independent actions.

When you use a third-party service linked from our website, you are subject to that service's own terms of service and privacy policy. We encourage you to review those terms and policies before providing information or using those services.

Website Disclaimer

This website and website content are provided on an "as available" basis. Native Ground does not guarantee that the website will always be available, uninterrupted, error-free, or completely current.

Website interruptions, technical errors, outdated information, or temporary unavailability may occur from time to time. We make reasonable efforts to maintain the website and keep information current, but we do not warrant that the website will be perfect or that every piece of information will always be completely accurate or up-to-date.

Limitation of Liability — Website Use Only

To the fullest extent permitted by applicable law, Native Ground Land Management LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating solely to your access to or use of, or inability to access or use, this website.

This may include damages arising from website interruptions, errors, omissions, technical issues, loss of data, reliance on general information presented on the website, or third-party websites or services linked from this website.

Nothing in these Terms is intended to limit or govern liability arising from land-management, forestry, grading, clearing, equipment operation, or other services actually performed by Native Ground Land Management LLC for a customer. Those services are governed separately by the applicable estimate, proposal, quote, work authorization, or other agreement between Native Ground Land Management LLC and the customer.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

Privacy

Information you submit through this website is handled according to Native Ground's Privacy Policy. Please review the Privacy Policy to understand how your information is collected, used, and protected.

Changes to These Terms

Native Ground may update these Terms from time to time. When we do, we will update the "Effective Date" at the top of this page. Your continued use of this website following any changes constitutes your acceptance of the updated Terms.

Governing Law

These Terms are governed by and interpreted in accordance with the laws of the State of Illinois, without regard to its conflict-of-law principles.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified or severed to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall remain in full force and effect.
